Title Insurance Issues
Title insurance insures real estate purchasers and mortgage holders against loss from defects in title, liens and encumbrances. A title policy generally states that, if the status of the title to a parcel of real property is other than as represented, the insurer will:
- take the necessary steps to resolve the title defect,
- defend any lawsuit attacking an insured’s title as insured,
- or reimburse the insured for any loss suffered as a result of the title defect, up to the face amount of the policy.
The amount of coverage provided by an Owner’s Policy of Title Insurance is generally equivalent to the purchase price of the real estate, while the amount of coverage provided by a Mortgagee Policy of title insurance is generally equivalent to the loan amount. The original premium charged when the policy is issued is your only cost as long as you own the property.
There are no annual payments to keep your title policy in force. An Owner’s Policy of Title Insurance is highly recommended for all purchasers of real estate and a Mortgagee Policy of Title Insurance is often required by lenders.
